Terms and Conditions of Sale

These Terms and Conditions of Sale (“Terms”) govern sales made on lumis-atelier.com by Lumis Atelier, 39 ter Rue du Bois Sauvage, 91000 France. Contact: contact@lumis-atelier.com.

1. Products

Lumis Atelier offers configurable lighting products, some of which are made to order. Photographs, dimensions, materials, colors, and features are presented with the greatest care. Slight variations related to materials, screens, or the manufacturing process do not necessarily constitute a defect.

A product is considered “customized” under these Terms only when it is made to the customer’s own specifications or clearly personalized, and when this classification is clearly stated before the order is placed. The words “made to order” or “pre-order” alone are not sufficient to remove the statutory right of withdrawal.

2. Prices and payment

The applicable prices are those displayed when the order is placed, including taxes where applicable. Any delivery charges, duties, and taxes are shown before final confirmation. Full payment is due when the order is placed, unless otherwise stated.

3. Order and manufacturing

The order becomes binding after payment has been validated and confirmation has been sent. For a made-to-order product, manufacturing may begin after this confirmation. The estimated manufacturing and delivery time is shown on the product page or during the ordering process. Lumis Atelier will inform the customer of any significant delay.

4. Right of withdrawal

For standard or non-customized products sold at a distance, consumers have a statutory period of fourteen (14) days from receipt to exercise their right of withdrawal, without having to give a reason. They may contact contact@lumis-atelier.com. Direct return costs remain the customer’s responsibility, except where the product is defective, damaged, or non-conforming.

In accordance with Article L. 221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized. This exception is applied only if the customized nature of the product was clearly stated before purchase.

5. Cancellation of a customized product before delivery

As a commercial concession, Lumis Atelier accepts cancellation of a customized product as long as manufacturing has not begun, with a full refund of the amounts paid.

Once customized manufacturing has begun, Lumis Atelier may accept cancellation and refund at least 70% of the product price. The amount retained may not exceed 30% and corresponds exclusively to materials, components, preparatory work, and irreversible costs already incurred for that order. It is limited to costs actually incurred and capable of being substantiated; it is therefore not automatically set at 30%.

This rule never applies when cancellation results from a breach by Lumis Atelier, failure to deliver under the conditions provided by law, a defect, damage, or non-conformity. It does not limit any statutory warranty.

6. Delivery

The delivery area, method, cost, and estimated time are displayed before the order is confirmed. Risk transfers to the consumer when the consumer takes physical possession of the product. In the event of delay, the customer benefits from the remedies provided by the French Consumer Code.

7. Receipt and returns

The customer is invited to check the condition of the parcel and product upon delivery and promptly report any issue, including useful photographs. Detailed procedures are provided on the Delivery & returns page.

8. Statutory warranties

Products benefit from the statutory warranty of conformity for two (2) years from delivery, as well as the warranty against hidden defects under the conditions provided by the French Civil Code. These warranties apply independently of any commercial warranty.

9. Liability and installation

Lighting products must be installed and used in accordance with the instructions supplied and applicable safety rules. Where required by the electrical installation, the use of a qualified professional is recommended. No clause limits Lumis Atelier’s statutory liability where it cannot be excluded.

10. Personal data

The processing of personal data is described in the Privacy Policy.

11. Complaints and mediation

Complaints may be sent to contact@lumis-atelier.com. After a prior written complaint remains unresolved, consumers may use, free of charge, the consumer mediator whose details will be provided in these Terms and the legal notice before the store opens for business.

12. Applicable law

These Terms are governed by French law, without depriving consumers residing in another country of any more protective mandatory provisions available in their country of residence. The parties will first seek an amicable solution to any dispute.
